Guardian is operated by TerraSecure ("TerraSecure", "we", "us"). By creating an account, subscribing to a plan or otherwise using Guardian, you enter into an agreement with TerraSecure on these terms.

By accessing or continuing to use Guardian you agree to these terms. If you are using Guardian on behalf of an organization, you confirm you have authority to bind that organization. If you use Guardian as an individual, you confirm you are of legal age.

Guardian provides asset discovery, authorized vulnerability scanning, application and cloud security assessment, endpoint posture reporting, compliance mapping, remediation workflow and reporting features, subject to the plan you select.

You may only scan or test assets that you own or for which you hold documented authorization from the owner. You are solely responsible for obtaining and retaining that authorization. Unauthorized scanning is a material breach of these terms.

You must not use Guardian to:

• break any applicable law or regulation;
• commit fraud, send spam, or misrepresent your identity or authorization;
• infringe the intellectual property or privacy rights of others;
• interfere with the security or integrity of the platform, including uploading malware, probing or attacking our infrastructure, or scraping the service;
• circumvent plan limits, rate limits or other technical controls.

You must provide accurate account information and keep it up to date. You are responsible for keeping credentials, API keys and agent enrollment tokens confidential and for all activity under your account. Scanner and connector credentials you store are used only to perform the assessments you configure.

We grant you a limited, non-exclusive, non-transferable right to use Guardian within your selected plan for your internal business purposes. You must not reverse engineer, resell or redistribute the service, or use it to build a competing product.

TerraSecure retains all ownership of Guardian and its intellectual property, including software, scanning logic, documentation and branding. You retain ownership of your data and content; you grant us a limited licence to host and process it solely to provide the service.

We work to keep Guardian available and accurate, but we do not guarantee uninterrupted or error-free performance. Scan results, risk scores and compliance mappings are provided to support your security judgement and do not guarantee the absence of vulnerabilities. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Subscriptions are billed in advance on the frequency shown at checkout (monthly or yearly) and renew automatically until cancelled. Payments, invoicing and applicable taxes are processed securely by our payment processor on behalf of TerraSecure. Please see our Refund Policy.

TerraSecure is the seller of Guardian subscriptions. Card details are collected and processed by our PCI-compliant payment processor; TerraSecure never stores full card numbers. Billing questions, invoices and refund requests are handled by TerraSecure at support@terrasecure.co.

We may suspend or terminate access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may cancel at any time. On termination your access ends; you may export your data during a 30-day window, after which it is deleted or anonymised.

To the fullest extent permitted by law, neither party is liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.

You will indemnify TerraSecure against claims arising from your content, your unauthorized or unlawful use of the service, or your breach of these terms.

You may not assign this agreement without our consent; we may assign it in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of the jurisdiction in which TerraSecure is established, and disputes are subject to the exclusive jurisdiction of its courts.
